Bayside Mediation we specialises in Family Dispute Resolution (FDR) and Workplace Mediation.
FDR Practitioners work hand in hand with solicitors providing the community with an alternative to expensive litigation and court appearances when couples end their marriages. FDRP’s negotiate and write parenting plans with couples; we negotiate access arrangements between parents and other significant adults in a child’s life. We resolve single issues that are preventing a completion to a settlement and we negotiate the financial settlements of separating couples.
FDRP’ s are trained in family law and hold degrees in other complimentary disciplines such as Psychology. We are registered with the Attorney General Department and are subject to stringent practice rules and guidelines. The documents we help negotiate can be formalised as Court Orders and Binding Financial Agreements and are considered as significant and will be given precedence should the matter proceed to court.
We also issue the 60 I certificate needed to take your matter to court. If a matter proves inappropriate for mediation or the matter cannot be resolved via mediation then the separating couple need a 60 I certificate to verify that fact so they can proceed to court. However, it is not unusual for magistrates to send a matter back to mediation if they feel the couple have not been genuine in their efforts to resolve their matter through mediation.
Mediation is non adversarial, it costs less, is more expedient, and in many cases more effective because the couple have negotiated the outcome for themselves rather than having an arbitrary legal professional decide for them.
Mediation is the way forward.
